Deliverance Poker Accuses Michael Mizrachi of Breach of Contract
Published on September 10th, 2010 6:03 am ESTOn September 7th, 2010, Deliverance Poker, LLC filed a lawsuit against Michael "The Grinder" Mizrachi and Tiltware, LLC (one of the companies associated with Full Tilt Poker).
The lawsuit was filed in the Texas Western District Court in Austin, Texas.
Deliverance Poker, LLC is the company behind Deliverancepoker.com. Deliverance Poker uses the tagline "Don't Get Screwed on the River" (lol).
Anyways, according to the recently filed lawsuit, Deliverance Poker, LLC claims that they entered into a contract with Michael "The Grinder" Mizrachi on July 12th, 2009. The contract called for Deliverance Poker to pay "The Grinder" $150,000. Mizrachi was also to receive a "membership interest of 1.75%" in Deliverance Poker, LLC, as well as some additional perks.
In return, Mizrachi (according to the lawsuit) was expected to compete in tournaments while wearing the Deliverance Poker brand, make personal appearances to promote the Deliverance Poker web site, etc.
Deliverance Poker claims that Mizrachi honored the terms of the contract until July of 2010, when he inked a sponsorship deal with Full Tilt Poker that "essentially replaced Plaintiff as Defendant Mizrachi's official sponsor".
Tiltware, LLC is also named in the suit because Deliverance Poker claims that Tiltware "knew or had reason to know of" Mizrachi's contract with the company. Deliverance Poker claims that Tiltware should have been aware of the deal simply based on the fact that Mizrachi had been wearing the Deliverance Poker logo in prior poker tournaments.
Deliverance Poker claims that "Tiltware willfully and intentionally interfered with the Deliverance contract".
Michael Mizrachi, along with his brothers Robert, Eric and Donny, are all still listed as "pros" on the Deliverance Poker web site.
The amount of damages that Deliverance Poker, LLC is seeking from Mizrachi and Tiltware isn't mentioned in the lawsuit.
